As texting and driving statistics continue to rise, many states have begun making this a legal offense. In Colorado, the texting and driving laws are more lenient than in other states but still enforced. If you have received a ticket, one of our experienced attorneys can help you figure out how to fight your case.

Texting and Driving Law

In Colorado, texting and driving is illegal only if texting and driving causes the driver to drive carelessly and improperly. Colorado's previous law banned texting and driving completely, but since the penalty has significantly increased the state changed the provision.

Penalties

The penalty for the previous law for texting and driving in Colorado was a $50 citation and one point added to the driver's record. The penalty is a $300 citation and four points added to the driver's record in the new law. With many such points added to their record, drivers risk their license being suspended, insurance premiums are likely to increase, or the driver may be dropped from their plan.

Ways to Avoid Texting and Driving

Although texting and driving can be a bad habit to break, there are tips and tricks you could try to help avoid hefty fees and points on your license. Next time you find yourself tempted to pull out your phone behind the wheel, try one of these:

  1. Texting and driving apps – There are many apps created to help drivers avoid cell phone distractions while driving. Each one is unique in its way, but most allow the driver to pick a few contacts whose calls come through while it sends an automated message to anyone else who tries to reach out.
  2. Turn it off – This is a good option for people who don't mind turning their phone off for a while. This will help avoid grabbing your phone when a notification sounds.
  3. Out of sight, out of mind – This is a better option for drivers who like to listen to music on their phones while driving. Make a playlist, and put your phone in a bag that is placed in the back seat. This way it is only accessible once safely stopped.
